Terms & Conditions

When booking a session, you agree to these terms of service upon paying your booking retainer fee. Any trade work agreed to by the photographer and another vendor is still subject to these terms and conditions:

This Agreement is between Cheyenne Brown Photography/CheyMedia (“Photographer”) and [You] (“Client”) which includes Client’s principals, employees, affiliates and representatives. Client agrees that it has the legal authority to enter into this Agreement on behalf of its employer, company or organization. Photographer’s relationship with Client is that of an independent contractor.

PAYMENT & SCHEDULING:

Deposits are not refundable within 48 hours of your selected appointment time. Reschedules cannot be made within a 48 hour window of your appointment time. The remainder of agreed upon payment is due at the termination of service. Any unforeseen fees not discussed (such as parking) is the responsibility of the Client to handle.

If a Photographer(s) and/or Videographer(s) is too ill or becomes injured and cannot supply the services specified, the Photographer(s) and Videographer(s) will try to book a replacement Photographer(s) and Videographer(s). If both Photographer(s) and Videographer(s) and are unavailable and a replacement cannot be found then liability is limited to a refund of any payments received. The Photographer(s) and Videographer(s) have working methods in place to prevent loss or damage to your photos and video. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of photo(s) and video supplied.

USAGE RIGHTS AND OWNERSHIP:

Copyright of the photos and video remains with the Photographer(s) and Videographer(s). The Photographer(s) and Videographer(s) grant the Client(s) permission to make copies of the images under the following conditions. The images and footage taken by the Photographer(s) and Videographer(s) are for personal use by the Client(s) and their friends and relatives. Sale, Publication or any Commercial use of the photos or video is not allowed without prior written permission from the Photographer(s) and Videographer(s). 

The Client(s) grants the Photographer(s) and Videographer(s) and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the video of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client(s) hereby release the Photographer(s) and Videographer(s) and its legal representatives, heirs and assigns from all liability and claims in connection with the photos and video. Every individual in attendance consents to being photographed or filmed. 

**Clients agree to the additional charge of $50 for raw photo distribution. Raw photos should not be posted/shared prior to the posting/sharing of edited photos by said Photographer(s). Clients shall not tag or mention Photographer(s) with any raw material.

SESSION TERMS:

 Sessions will be conducted at a location agreed upon by the photographer.  The photographer will not trespass or use any property/locations that is considered unlawful to do so.  The photographer is bound by any rules states for the property or location.  If the Client wishes to shoot on private property it is the Client’s soul responsibility to get authorization from the owner of the property.  The photographer is not responsible for hazards at the location and the Client agrees to enter into the session at their own risk.

 No other photographers/videographers are allowed during the session unless agreed upon prior to session.  Client or guests will refrain from taking cell phone images during the session unless agreed upon by the photographer.
